AGREEMENT TO TERMS
By accessing or using this website and any related services, you agree to be bound by these Terms of Use, our Privacy Policy, and all applicable laws. If you do not agree, do not use this site. The materials on this website are protected by copyright, trademark, and other laws.

ELIGIBILITY AND ACCOUNT
You must provide accurate information and maintain the security of your account credentials. You are responsible for all activity that occurs under your account.

LICENSE TO USE THE SITE
We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the site for personal, non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content or software on this site. Any unauthorized use terminates the license.

COURSE ACCESS AND SINGLE-USER LICENSE
Purchase provides one learner with access to the specific course selected. Sharing logins, re-selling access, or using automated tools to bypass lessons, knowledge checks, or completion requirements is prohibited.

PRICING, TAXES, AND FEES
Prices are shown at checkout and may change at any time before purchase. Applicable taxes and, in some jurisdictions, required government or permitting fees may be collected at checkout. Where a jurisdiction requires us to collect and remit a permit fee to a health department (for example, certain Utah local health departments or San Diego County), that fee will be shown at checkout. See Cancellation and Refunds below for how government/permit fees are handled.

PAYMENTS
Payments are processed by third-party processors (for example, Stripe or PayPal). By paying on our site, you agree to comply with your selected processor’s terms. We do not store full payment card numbers on our servers.

CANCELLATION AND REFUNDS

General refunds
• You may request a refund within 30 days of purchase if you have not started the course. Once any portion of the course has been accessed, general refunds are not available.
• Printed certificate add-on with a general refund: refundable only if printing has not begun. Once printing has begun or the item has shipped, the add-on is non-refundable.

Acceptance guarantee (food handler course) — exception to the “not started” rule
• If your FoodSafePal food handler card is not accepted by your local health department or employer in a state we list as accepted, contact us within 30 days of purchase and we will refund the course price.
• This guarantee is an exception to the “not started” rule above; you may have started or completed the course and still qualify.
• To process the refund, provide your order number, state, and either (a) a brief note or email from the agency/employer stating non-acceptance, or (b) a link/screenshot of their policy showing the reason.
• Exclusions: Washington and Alaska; purchases of the wrong product for your role (e.g., a manager-level credential required); any government/permit fees already remitted to an agency. Examples include certain Utah local health departments and San Diego County where a local permit fee may be collected and remitted; once remitted, that fee is not refundable.
• Printed certificate add-on with an acceptance-guarantee refund: refundable only if printing has not begun. Once printing has begun or the item has shipped, the add-on is non-refundable.

Free state/language swap
• If you purchased the wrong state course or language by mistake, we will switch you within 30 days at no cost.

Government/permit fees (Utah; San Diego County)
• If a jurisdiction requires us to collect and remit a government or permit fee to a health department, that portion of your payment is non-refundable once remitted.
• If a refund is approved before we remit the fee, we will refund both the course price and the unremitted fee.

PRINTED CERTIFICATE ADD-ON

• The printed certificate is an optional, custom-printed add-on to your digital certificate.
• Processing time: Typically prepared and handed to the carrier within 2–3 business days after purchase or course completion. Processing times may vary; weekends and U.S. holidays are not business days. No guaranteed ship date is offered.
• Refunds: The add-on is refundable only until printing begins and only as part of an approved course refund (general refund or acceptance-guarantee refund). After printing has begun or the item has shipped, the add-on is non-refundable.
• Delivery: Carrier transit times vary and are outside our control once handed to the carrier.
• Reprints: If your printed certificate arrives damaged or does not arrive within 21 calendar days of the ship date to a U.S. address, contact us for a complimentary reprint to the same address (limit one reprint per order).
• Address/Name changes: If you need to correct the shipping address or name after printing has begun or the item has shipped, a new add-on purchase may be required.

DELIVERY OF DIGITAL CERTIFICATES
Digital certificates are issued to your dashboard upon successful course completion. Keep your account email up to date so you can access your records.

FOODSAFEPAL FOOD HANDLER CERTIFICATE USAGE
You may refer to your credential as a “FoodSafePal Food Handler Certificate” or “FoodSafePal Food Handler Card.” You and your managers may not state or imply that you are “certified,” “certificated,” “licensed,” “registered,” or “accredited.” Certificates may not be altered, reproduced deceptively, or transferred to another individual.

USER CONDUCT
You may not impersonate others, share login credentials, misrepresent course completion, attempt to circumvent lesson progression, tamper with certificates, or interfere with site security. Violations may result in access termination, invalidation of a certificate, and other remedies.

REVIEWS AND TESTIMONIALS
By submitting a review or testimonial, you grant Dakota Dietitians, LLC d/b/a FoodSafePal a non-exclusive, worldwide, royalty-free license to use your feedback, name (or initials), and submitted content for promotional purposes on our website, social channels, and marketing materials. Your email address will not be published.

THIRD-PARTY SITES
Links to third-party websites are provided for convenience only. We do not control or endorse those sites and are not responsible for their content or practices. Use of any linked site is at your own risk.

INTELLECTUAL PROPERTY
All content, trademarks, logos, and software on this site are owned by Dakota Dietitians, LLC d/b/a FoodSafePal or its licensors and are protected by law. No rights are granted except as expressly set out here.

DISCLAIMERS
The site and its materials are provided “as is” and “as available.” Dakota Dietitians, LLC d/b/a FoodSafePal disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, that defects will be corrected, or that information is current or accurate.

LIMITATION OF LIABILITY
To the maximum extent permitted by law, Dakota Dietitians, LLC d/b/a FoodSafePal and its suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or business, arising from or related to your use of the site, courses, or materials, even if advised of the possibility of such damages. Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the fullest extent permitted by law.

INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Dakota Dietitians, LLC d/b/a FoodSafePal and its officers, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the site or violation of these Terms.

REVISIONS AND AVAILABILITY
Materials on the site may include technical, typographical, or photographic errors. We may change content and availability at any time without notice and do not commit to update materials.

MODIFICATIONS TO TERMS
We may revise these Terms at any time. The updated version will be posted with a new effective date. By continuing to use the site, you agree to the then-current Terms.

GOVERNING LAW
These Terms are governed by the laws of the State of South Dakota, without regard to its conflict of law rules. Venue and jurisdiction lie in the state and federal courts located in South Dakota.
