By accessing or using this website and any related services, you agree to be bound by these Terms of Use, our Privacy Policy, and all applicable laws. If you do not agree, do not use this site. The materials on this website are protected by copyright, trademark, and other laws.
ELIGIBILITY AND ACCOUNT
You must provide accurate information and maintain the security of your account credentials. You are responsible for all activity that occurs under your account.
LICENSE TO USE THE SITE
We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the site for personal, non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content or software on this site. Any unauthorized use terminates the license.
COURSE ACCESS AND SINGLE-USER LICENSE
Purchase provides one learner with access to the specific course or examination selected. Sharing logins, re-selling access, or using automated tools to bypass lessons, knowledge checks, or completion requirements is prohibited. Exam purchases are non-transferable and may only be used by the individual whose identity was verified at the time of the exam session.
PRICING, TAXES, AND FEES
Prices are shown at checkout and may change at any time before purchase. Applicable taxes and, in some jurisdictions, required government or permitting fees may be collected at checkout. Where a jurisdiction requires us to collect and remit a permit fee to a health department (for example, certain Utah local health departments or San Diego County), that fee will be shown at checkout. PAYMENTS
Payments are processed by third-party processors (for example, Stripe or PayPal). By paying on our site, you agree to comply with your selected processor’s terms. We do not store full payment card numbers on our servers.
CHARGEBACKS AND PAYMENT DISPUTES
Filing a chargeback for a legitimate, authorized purchase constitutes misuse of the payment process and a breach of these Terms. If you believe a charge was made in error, contact us at (800)-426-1344. Most issues can be resolved quickly without involving your card issuer.
By completing a purchase, you acknowledge that:
- Access to digital course materials is delivered immediately upon payment, and such access constitutes fulfillment of the service.
- For proctored certification examinations, fulfillment includes delivery of the proctored exam session, identity verification services, and session recording, all of which are initiated upon launch of the exam session.
- Your card statement will show the descriptor “FoodSafePal” (or similar).
- We maintain transaction logs, IP addresses, access timestamps, session recordings, identity verification records, and certificate issuance records as proof of delivery and authorization.
If a chargeback is initiated after accessing a course, launching an exam session, or receiving a certificate, we may:
- Deny future enrollments connected to your name, email, payment method, or IP address;
- Send a separate invoice for any amounts owed for services already provided (no automatic recharging of your card will occur); and
- Pursue recovery through reasonable means permitted by law, including small-claims proceedings if appropriate.
We reserve the right to provide evidence to payment processors — including session recordings, identity verification records, and access logs — demonstrating fulfillment and authorization of the transaction to contest any unwarranted dispute.
CANCELLATION AND REFUNDS
All purchases are subject to FoodSafePal’s Refund Policy, which is incorporated into these Terms by reference and available at foodsafepal.com/refunds. Please review the Refund Policy carefully before completing your purchase.
PRINTED CERTIFICATE ADD-ON
The printed certificate is an optional, custom-printed add-on to your digital certificate.
- Processing time: Typically prepared and handed to the carrier within 2–3 business days after purchase or course completion. Processing times may vary; weekends and U.S. holidays are not business days. No guaranteed ship date is offered.
- Refunds: Refund eligibility for the printed certificate add-on is governed by FoodSafePal’s Refund Policy at foodsafepal.com/refunds.
- Delivery: Carrier transit times vary and are outside our control once handed to the carrier.
- Reprints: If your printed certificate arrives damaged or does not arrive within 21 calendar days of the ship date to a U.S. address, contact us for a complimentary reprint to the same address (limit one reprint per order).
- Address and Name Changes: If you need to correct the shipping address or name after printing has begun or the item has shipped, a new add-on purchase may be required.
DELIVERY OF DIGITAL CERTIFICATES
Digital certificates are issued to your dashboard upon successful course or exam completion. Keep your account email up to date so you can access your records.
FOODSAFEPAL FOOD HANDLER CERTIFICATE USAGE
You may refer to your credential as a “FoodSafePal Food Handler Certificate” or “FoodSafePal Food Handler Card.” You and your managers may not state or imply that you are “certified,” “certificated,” “licensed,” “registered,” or “accredited.” Certificates may not be altered, reproduced deceptively, or transferred to another individual.
FOODSAFEPAL FOOD HANDLER CERTIFICATE USAGE
Upon passing the FoodSafePal Food Safety Manager Certification Exam and meeting all certification requirements, you may refer to yourself as a “Certified Food Safety Manager” and display your official FoodSafePal certificate and wallet card. You may use the certification marks on business cards and professional letterhead while your certification remains valid and in good standing.
You may not misrepresent your certification status, claim certification before it has been officially issued by FoodSafePal, or continue to use certification marks after your certification has expired, been revoked, or been suspended. Certificates may not be altered, reproduced deceptively, or transferred to another individual. Use of FoodSafePal trademarks in advertising or promotional materials requires prior written approval from FoodSafePal. Violations may result in certification revocation and other remedies available under FoodSafePal’s Disciplinary Policy.
USER CONDUCT
You may not impersonate others, share login credentials, misrepresent course or exam completion, attempt to circumvent lesson progression or exam security measures, tamper with certificates, or interfere with site security. Violations may result in access termination, invalidation of a certificate or certification, and other remedies.
REVIEWS AND TESTIMONIALS
By submitting a review or testimonial, you grant Dakota Dietitians, LLC d/b/a FoodSafePal a non-exclusive, worldwide, royalty-free license to use your feedback, name (or initials), and submitted content for promotional purposes on our website, social channels, and marketing materials. Your email address will not be published.

Links to third-party websites are provided for convenience only. We do not control or endorse those sites and are not responsible for their content or practices. Use of any linked site is at your own risk.
INTELLECTUAL PROPERTY
All content, trademarks, logos, and software on this site are owned by Dakota Dietitians, LLC d/b/a FoodSafePal or its licensors and are protected by law. No rights are granted except as expressly set out here.
DISCLAIMERS
The site and its materials are provided “as is” and “as available.” Dakota Dietitians, LLC d/b/a FoodSafePal disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, that defects will be corrected, or that information is current or accurate.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Dakota Dietitians, LLC d/b/a FoodSafePal and its suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or business, arising from or related to your use of the site, courses, examinations, or materials, even if advised of the possibility of such damages. Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the fullest extent permitted by law.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Dakota Dietitians, LLC d/b/a FoodSafePal and its officers, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the site or violation of these Terms.
REVISIONS AND AVAILABILITY
Materials on the site may include technical, typographical, or photographic errors. We may change content and availability at any time without notice and do not commit to update materials.
MODIFICATIONS TO TERMS
We may revise these Terms at any time. The updated version will be posted with a new effective date. By continuing to use the site, you agree to the then-current Terms.
GOVERNING LAW
These Terms are governed by the laws of the State of South Dakota, without regard to its conflict of law rules. Venue and jurisdiction lie in the state and federal courts located in South Dakota.
